Terms of Service

Effective date: October 19, 2026

These Terms of Service (“Terms”) govern your access to and use of the Commune website, applications, and related services (collectively, the “Service”), operated by FreeHumans LLC (“Commune,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use Commune

You must be at least 18 years old and able to enter a binding agreement to create an account or use account features. You are responsible for the accuracy of information you provide and for keeping your credentials secure. Do not share credentials or allow another person to use your account. Notify us promptly if you suspect unauthorized access.

2. What the Service does—and does not do

Commune provides software intended to help groups coordinate shared assets, activities, records, expenses, schedules, and decisions. Features may change, be unavailable, or be introduced in stages.

Commune is not a party to arrangements between members and does not own, inspect, operate, insure, broker, finance, appraise, or manage members' property. We do not verify title, ownership, condition, safety, permissions, identity, or a member's authority to share an asset. We do not guarantee bookings, access, exchange-credit values, income, savings, asset availability, or any outcome from using the Service.

Commune does not provide legal, tax, accounting, investment, financial, insurance, real estate, or safety advice. Any templates, calculations, summaries, AI-assisted tools, or records are informational aids only—not professional advice, legal documents reviewed for your circumstances, or a substitute for independent professional judgment. You and your group are responsible for obtaining advice and making your own decisions.

3. Groups, assets, and member agreements

You are responsible for ensuring you have the legal right and any required consent to create a group, upload material, invite people, and share information or assets. You are responsible for the accuracy and legality of your content and for informing members about how group records and information will be used.

Members—not Commune—must establish and follow their own agreements covering ownership, contributions, access, scheduling, expenses, reimbursements, care, liability, insurance, dispute handling, transfers, departures, and dissolution. A record or vote in the Service does not by itself create or amend a legally enforceable agreement, establish ownership, or satisfy formalities required by law. Commune is not a party, fiduciary, agent, trustee, property manager, or mediator for a member agreement.

Before sharing an asset, members should independently confirm ownership rights, permits, licenses, safety requirements, tax consequences, and insurance coverage for the intended use. Do not assume personal coverage, marketplace protections, or any third-party policy applies. A group is responsible for setting and following its own rules and for resolving disagreements among its members.

4. Your content and group visibility

“Content” means information or material you submit to or create through the Service, including messages, profiles, records, receipts, files, agreements, images, schedules, votes, and expense details. You retain ownership of your Content. You grant Commune a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, and process Content only as reasonably necessary to provide, secure, support, and improve the Service and comply with law.

Content placed in a Commune may be visible to its members, administrators, or people you invite, depending on the feature and group settings. You are responsible for checking access and sharing settings before uploading or inviting others. Do not upload information about another person unless you have authority to do so. Do not upload confidential, sensitive, or regulated information unless the Service expressly supports it and you have the necessary rights and consent.

You authorize us to make your Content available to the members and recipients you select to operate the features you use. We may remove Content that violates these Terms or creates a legal, safety, or security risk.

5. Acceptable use

You agree not to:

  • break the law, infringe another person's rights, or facilitate unlawful conduct;
  • misrepresent ownership, authority, identity, asset condition, or financial information;
  • harass, threaten, defraud, discriminate against, or unlawfully surveil another person;
  • upload malware, attempt unauthorized access, probe or disrupt the Service, or bypass security;
  • scrape, reverse engineer, copy, resell, or exploit the Service except as permitted by law;
  • use the Service to create or distribute unlawful, deceptive, or harmful material; or
  • use Commune to hold, pool, transmit, or invest money except through a feature and payment provider expressly made available for that purpose.

6. Fees, subscriptions, and payments

The Service currently may include proposed pricing and feature descriptions that are not live subscriptions or payment functionality. If we make a paid feature available, we will show the applicable price, billing period, included features, and any platform or provider fee before you authorize payment. Taxes may apply. The terms displayed at purchase will control the specific subscription or transaction.

If a subscription is offered, it renews only as described at checkout. You may cancel future renewals through the method provided for that subscription; cancellation generally takes effect at the end of the current paid period unless applicable law or the checkout terms require otherwise. Fees already incurred, refunds, and any trial terms will be governed by the disclosures shown when you subscribe and applicable law.

Payment features, if offered, may be provided by independent payment processors under their own terms and privacy notices. Commune does not currently hold pooled purchase funds and does not act as a bank, escrow agent, money transmitter, or custodian. Do not send pooled funds to Commune. A payment provider may impose its own fees, eligibility rules, verification requirements, reversals, or dispute processes.

7. Third-party services and transactions

The Service may link to third-party websites, software, payment services, insurers, vendors, or professional services. Those providers operate independently and may have separate terms and privacy practices. Commune does not control or endorse them and is not responsible for their services, advice, availability, acts, or omissions. Any transaction, service, or agreement between you and another user or provider is between those parties.

8. Intellectual property

Commune and its licensors own the Service, including its software, design, text, branding, and other materials, except for Content submitted by users. We grant you a limited, revocable, non-transferable, non-exclusive right to use the Service for its intended personal or organizational purpose while you comply with these Terms. No other rights are granted by implication.

9. Privacy

Our Privacy Policy explains how we handle personal information. It is incorporated into these Terms. You should not submit personal information through the Service unless you have the right to do so and understand who may see it.

10. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access, remove Content, or discontinue a feature if reasonably necessary to protect users, comply with law, address a security or operational risk, enforce these Terms, or discontinue the Service. Where practical, we will provide notice and a reasonable opportunity to address a remediable violation. We are not responsible for loss caused by a suspension or discontinuation to the extent permitted by law.

When your access ends, your right to use the Service ends. You should export or retain copies of records you need before access ends. We may retain information as described in the Privacy Policy or as required for legal, security, accounting, or dispute-resolution purposes. Provisions that by their nature should survive termination will survive, including those concerning Content licenses already granted, intellectual property, disclaimers, liability, and disputes.

11. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, OR THAT CONTENT WILL BE PRESERVED.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMUNE AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, USE, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF COMMUNE AND THOSE PERSONS FOR ALL CLAIMS RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO COMMUNE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. These limits do not exclude liability that applicable law does not allow to be excluded or limited, including liability for intentional misconduct where such a limitation is prohibited.

13. Indemnification

To the extent permitted by law, you will defend and indemnify Commune against third-party claims, losses, and reasonable expenses arising from your unlawful use of the Service, your Content, your breach of these Terms, or your dispute or transaction with another user or provider. We will give you reasonable notice of a claim and allow you to participate in its defense; you may not settle a claim in a way that imposes an obligation or admission on Commune without our written consent. This section does not apply where prohibited by law.

14. Changes to these Terms

We may update these Terms to reflect changes in the Service, law, or our operations. We will update the effective date and, where a change is material, provide notice by a reasonable method before it takes effect when practicable. Your continued use after the effective date means you accept the revised Terms. If you do not agree, stop using the Service.

15. Governing law and disputes

Washington State law governs these Terms, without regard to conflict-of-law principles. The parties will first make a good-faith effort to resolve a dispute informally by contacting the other party. If it is not resolved, the state and federal courts located in Washington State will have exclusive jurisdiction and venue, and each party consents to those courts, subject to any non-waivable rights under applicable law.

16. General terms

These Terms and the Privacy Policy are the entire agreement between you and Commune about the Service and replace prior agreements on that subject. If any part is unenforceable, the remaining parts remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, reorganization, or transfer of the Service, subject to applicable law. These Terms do not create an agency, partnership, joint venture, or employment relationship between you and Commune.
